Charterers’ Liability Insurance: what to consider
Charterers’ liability insurance addresses specified liabilities arising from the charterer’s use or employment of a vessel. Time and voyage charterers may face claims involving damage to the ship, cargo, bunkers or third parties. The charterparty and actual chartering activities are central to assessing the exposure.
Start with the charter arrangement
Identify a time charter, voyage charter or other arrangement and explain any subchartering chain. Bareboat arrangements create a different responsibility profile and should be disclosed expressly. Supply the contract rather than assuming that an owner’s P&I entry protects the charterer.
Examine operational promises
Bunker supply, cargo handling, port nomination and contractual indemnities can affect the risk. Describe commodities, hazardous cargoes and trading areas. Check insurance against obligations accepted in the charterparty, including terms that extend beyond ordinary legal liability.
